By inquiring for, asking for a quote or commissioning Xe-Li you are confirming that you have read the below rules, terms and conditions and are agreeing to them.
1. GENERAL TERMS.
By sending payment the customer agrees to the rules outlined in the Terms of Service (ToS)
The Artist has the right to cancel the commission at any point such as due to the following: Rude Behavior, Poor Communication, Ghosting, Burnout, Harassment and similar.
Created artwork will only be Safe for Work (SFW). Do not inquire about NSFW artwork.
2. PAYMENT & REFUNDS.
Work on the commission will only start once payment has been received in full with invoices being sent out over paypal by the artist. The only accepted currency is Euro € (unless specified otherwise by the artist).
The client can request a refund yet the amount being paid back depends on how much work the artist has done on the commission already. If work has not yet started then the client will receive a full refund. Should work have been partially completed then the client will be sent back the amount of payment that equals the polish levels of the artwork that have not yet been started on.
A refund will not be given out if the artwork is already completed.
3. COPYRIGHT / USAGE POLICY.
The artist retains the rights to their artwork even after completion. As such the artist reserves the right to use the artwork to advertise commission openings, post it to their online galleries and use it to advertise physical merchandise where applicable.
The client is only permitted to use the artwork for personal use/non profit. A Purchase of Commercial rights to the artwork will always be 200% of the original commission price and needs to be discussed when the commission is ordered, its not permitted to be paid for retroactively, due to points 1 and 3 in this section clashing. With commercial rights the client is allowed to use the artwork for creation of merchandise. Credit is still required for usage of the artwork, even if altered or edited.
Artwork will always be publically displayed with the exception of artwork which has been purchased with Commercial rights as these drawings will be heavily cropped or downsized for upload, if the client allows for the upload of the artwork.
The client may request to remain anonymous in the upload of the artwork.
The client may reupload the commissioned work but must give credit to the Artist.
A Commission will be completed between 2 weeks and 3 months depending on many factors such as; Health, Client spot in the commission queue, complexity of commission, Work and studies.
Should a long term delay to a clients commission be unavoidable due to major life changes or similar then the Client will be notified at the earliest convenience, refunds can be discussed at that point should the client wish to.
A client may not place a deadline onto an artpiece without first talking to the Artist in the Commission Ordering Process. Commissions with deadlines are possible at the inclusion of a fee which is higher the more narrow the completion time of the Commission for the Artist is.
The Client will receive a sketch draft from the Artist for approval and then the finished artwork for revisions.
Further Work in Progress pictures will exclusively be given if the client personally ask for them and only if the commission price exceed 30€ (though hourly/daily inquiries will be seen as harassment and will cause the artist to cancel your commission).
5. CUSTOMER SATISFACTION, EDITS & REVISIONS.
The Client may request changes and revisions free of charge during the sketch phase of the commissioned artwork.
Edits and Revisions after the sketch stage of a commissioned artwork will incur a fee based on how much needs to be redone for the requested edit.
Should the artist miss a detail or similar due to it being not present in the artwork provided as reference for the Commission of the character then the client must pay a fee to adjust the commissioned artwork. It is the clients responsibility to provide a reference that is accurate to the character they are commissioning artwork of.
Major Changes like palette changes, background changes, the inclusion or removal of an outfit will not be made after the client approved the sketch of the commission piece.
6. DATA COLLECTION.
Data Collection by the Artist is only strictly for communication purposes and delivery of the Commission.
Do not send the artist an email if you are not okay with your Data being kept for half a year for record purposes.
